Aftermarket vs. OEM batteries and the chain of liability
When a lithium-ion product catches fire, the first instinct is to look at the brand on the device. But the battery, the charger, and the cells inside are often made by entirely different companies — and increasingly, they were never the ones the manufacturer intended. Sorting out who supplied what is frequently the whole case.
One product, many makers
A single battery-powered product can involve a surprising number of parties: the company that made the individual cells, the assembler that built them into a pack, the manufacturer of the device, the maker of the charger, an importer, a distributor, an online marketplace, and a retailer. Any of them can sit somewhere in the chain of causation.
That chain gets more complicated when parts are swapped. The market is full of aftermarket replacement packs, "universal" chargers, and third-party cells — many inexpensive, some uncertified, and a meaningful number counterfeit. When an original component is replaced with one of these, the liability picture shifts with it.
The scenarios that change the analysis
A few recurring patterns tend to drive where responsibility lands:
- OEM device with OEM battery and charger. The failure points back toward the original manufacturer or its component suppliers, and the questions center on design and manufacturing.
- OEM device with an aftermarket battery or charger. The introduced component becomes a prime suspect — was it compatible, was it certified, did it meet the device's charging requirements? Responsibility may shift toward the aftermarket supplier and away from the device maker.
- Counterfeit or substandard cells. Cells that imitate a reputable brand but are not genuine are a common thread in serious fires. Establishing that a cell is counterfeit can redirect the case entirely — and implicate the marketplace or importer that put it in the stream of commerce.
- Mismatched charging. A charger that overcharges or is incompatible with the pack can cause a failure that has nothing to do with the cell's own quality.
Why it matters for recovery and defense alike: a subrogation professional needs to identify solvent, reachable, genuinely responsible parties. A defense team needs to know whether an introduced aftermarket component — not their client's product — actually caused the loss. Both depend on correctly identifying every component.
How the components get identified
Determining whether a battery or charger was original or aftermarket, genuine or counterfeit, is a technical exercise. It draws on cell markings and construction, pack design, the presence or absence of legitimate safety certifications and listings, comparison against known-genuine exemplars, and the physical evidence of how the components interacted.
Much of that hinges on evidence that is easy to lose: the packaging, the charger and cables, purchase records, and online listings. Preserving those alongside the device and battery keeps the full chain of liability open for examination.
